This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 123 of 2023 registered at Indapur Police Station, for the offences punishable under Sections 353, 504, 506, 294 of Indian Penal Code and Section 92 of the Rights of Person with Disabilities Act, 2016. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on the date of incident which took place on 30 January 2023, the present applicant came to the office of complainant,who on the date of incident was working as Circle Officer,and abused him in filthy language as he had passed order adverse to the applicant in the case filed by him.

The applicant has tendered apology to the complainant. There are no other criminal antecedents. Apart from it, there appears to be no need of custodial interrogation. Considering the overall facts and circumstances, I am inclined to grant anticipatory bail to the present applicant on certain condition. In the result, the following order is passed : (i) Application is allowed.

(ii) In the event of arrest of the applicant - Pravin Ganpat Babar in Crime No. 123 of 2023 registered at Indapur Police Station, for the offences punishable under Sections 353, 504, 506, 294 of Indian Penal Code and Section 92 of the Rights of Person with Disabilities Act, 2016, he shall be released on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount. (iii) The applicant shall attend the concerned police station daily i.e. from 20.04.2023 between 11.00 a.m. to 2.00 p.m. till filing of chargesheet and shall co-operate in the investigation. (iv) The prosecution is at liberty to file application for cancellation of bail, if the applicant commits breach of above said condition. by KANCHAN PRASHANT DHURI Date:
