Heard Mr. Nimbalkar, learned Counsel for the Applicant and Mr. Malshe, learned APP for the Respondent-State. 2.

Mr. Nimbalkar, learned Counsel for the Applicant after arguing the matter for some time and as this Court is not inclined to grant bail, seeks withdrawal of the Bail Application. 3.

The allegations in the F.I.R. are very serious. The case is of gang rape.

The statement of father of the victim shows that the victim is married and her second child passed away within few days of the birth and therefore, the victim is psychologically disturbed since then.

The certificate issued by the Institution for Psychological Health, Pune shows that victim suffers marked symptoms of Post Traumatic Stress Disorder, selective mutism, regressive behaviour with complete denial about the traumatic event. The father of the victim has reported that there are significant behaviour changes after the incident. Even the statement dated 21st October 2021 of Dr. Savita Gaikwad shows that due to the incident the victim has suffered psychological trauma.

Accordingly, the Bail Application is allowed to be withdrawn and dismissed as such. However, in the facts and circumstances of this case, the learned Trial Court is requested to conclude the trial expeditiously.
