By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Marriage Petition No. A-1363 of 2015 filed by the Respondent-husband seeking divorce pending before the Family Court at Pune to the Family Court at Bandra, Mumbai. 2.

Both the parties are educated and since both are of the view that they will be inconvenienced if they are required to travel, the following order is passed, by consent. (i) The Family Court at Pune shall conduct the proceedings in Marriage Petition No.A-1363 of 2015 through video-conferencing. (ii) The District Court at Pune shall render all assistance to the Family Court at Pune to enable the Court to conduct the proceedings through videoconferencing. In the event of any difficulty, the Respondent undertakes to provide a laptop, WIFI and other equipments necessary to conduct the proceedings through

(iii) The Applicant-wife shall be allowed to file written statement within a period of four weeks from today and also to cross-examine the Respondent and thereafter, file her affidavit in lieu of evidence. (iv) The respective Courts shall not grant any adjournment to the parties unless absolutely necessary.

(v) The parties too shall not seek any adjournment unless absolutely necessary.

(vi) The Learned Judge, Family Court, Pune shall endevour to dispose off the Marriage Petition No.A-1363 of 2015 within a period of six months from the date of this order.

(vii) Since the proceedings shall be conducted through videoconferencing, the Court shall fix the hearing of the matter at the time specified in advance.
