The cheque amount is only of about Rs.25,000/-. The applicant has been convicted and his conviction for the offence punishable under Section 138 of the Negotiable Instruments Act has been confirmed. He is in jail at present. Considering the cheque amount, I am inclined to pass the following order :

ORDER

The applicant be released on bail in the sum of Rs.5,000/- with one surety in the like amount or cash deposit of Rs.5,000/- in lieu of surety. The substantive sentence imposed on the applicant shall remain suspended till the decision of the Revision Application. The present application stands disposed of.

The Superintendent of Prison, trial court and the parties to act on authenticated copy of this order.
