1] By a reasoned Order dated 13th March, 2018, the applicant was granted interim relief.
2] Heard the learned counsel for the applicant and the learned APP for the State. Perused the record.
3] Only allegation against the applicant is that, he assured the first informant that the residential premises which was sold to him will be converted into commercial premises by taking due permission from the Pune Municipal Corporation and ultimately he failed to do so. 1/2
aba.495-2018.doc 4] The investigation pertaining to the aforestated allegation is solely based on documents which are either in the custody of the first informant or have already been seized by the police from Pune Municipal Corporation. In view thereof, this Court is of the opinion that, the custodial interrogation of the applicant for further investigation of the present crime is not necessary.
5] Interim relief granted by an Order dated 13th March 2018 is hereby confirmed.
However, the condition to attend the Investigating Officer is waived.
6] Application is allowed in the aforesaid terms. (A.S.GADKARI, J.) 2/2
