Heard Mrs.N.S.K. Ayubi, learned counsel for the applicant.
Undoubtedly, some arguable points are raised. However, I find that the application for suspension was previously rejected (Criminal Application No.402/15 decided on 8/7/2015) (Coram A.R. Joshi, J). Under these circumstances, after considering all the relevant aspects of the matter, in my opinion, it would be proper to expedite the hearing of the Appeal itself instead of reconsidering the question of suspension of sentence.
Tilak 2/2 (17)APPA-371-16 In view of this observation, the learned counsel for the applicant, at this stage, seeks permission to withdraw the application.
Application is allowed to be withdrawn, and stands dismissed as such.
Hearing of the Appeal is expedited.
The Appeal be listed for final hearing in the week commencing from 13th June 2016.
