The above Civil Applications are filed for condonation of delay of
24 days in filing the Applications for restoration of the above Letters Patent Appeals. The reasons for the delay are mentioned in the Civil Applications. The learned Counsel for the Respondent submits to the order of the Court. She further points out that the Letters Patent Appeals filed by the Respondent have also been dismissed for non-prosecution on the same day. And that the the Respondent has also filed Applications for restoration. The learned Counsel appearing for the Applicant in the above Civil Applications fairly states that the said Letters Patent Appeals may also be restored as and when the said applications come up before this Court. The above Civil Applications are accordingly allowed. Resultantly, the delay of 24 days in filing the Applications for restoration stand condoned.
By the consent of the learned Counsel for the parties, Civil Application (stamp) Nos. 7523 of 2017 and 7529 of 2017 are taken up for hearing. By the order passed, the delay in filing the above Civil Applications for restoration of the Letters Patent Appeals has been condoned. In view
thereof, the above Civil Application Nos. 7523 of 2017 and 7529 of 2017 are allowed. Resultantly, the above Letters Patent Appeal Nos. 183 of 2005 and 167 of 2005, which were dismissed for non-prosecution stand restored to file.
