The petitioner submits that the concerned Talathi is not mutating the name of the petitioner in respect of land bearing Survey Nos.134, 135 and 136. According to the learned advocate, the mutation entry in the name of Government is incorrect. The petitioner attempted to file an appeal. The same was not accepted. 2.

In case the appeal is filed by a litigant, the authority before whom the appeal is filed and is competent to decide the appeal, has to accept the appeal. The appeal has to be in a proper form. 3.

The Appellate Authority may decide the appeal one way or the other depending upon the merits of the matter. However, may not be refused to accept the appeal.

With these observations, the writ petition is disposed of. No costs.
