After arguing for some time, learned counsel for the Applicant has not pressed this application. He has relied on the averments in paragraph-7 of the plaint which in fact protects his interest; according to him the Plaintiff has in fact accepted the contention of the Applicant in the said paragraph-7 of the plaint.

Since the Applicant does not want to pursue this application, it is allowed to be withdrawn and is disposed of as such. All the contentions raised by the Applicant are left open to be decided at the appropriate stage.
