Learned counsel for applicant at the outset submits that previous application was rejected by this Court vide order dated 28th February 2019. Subsequently another application was withdrawn on 20th September 2020. However, liberty was granted to prefer application after six months if the appeal is not taken up for final hearing.

On instructions it is submitted that the application may be allowed to be withdrawn with liberty to prefer application for suspension of sentence after the applicant undergoes half of the sentence awarded by Trial Court. In view of the submission, the application is allowed to be withdrawn with liberty as prayed for. Application is disposed of.
