IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO.290 OF 2016 Vikram Suresh Adhav and another Applicants versus The State of Maharashtra and another Respondents Mr.Anil Kumar Pandey for Applicants.
Mr.N.B.Patil, APP, for State.
CORAM : S.C.DHARMADHIKARI AND PRAKASH D. NAIK, JJ.
DATE :
26th April 2017 PC :
1.
On 6th April 2017 we had passed a detailed order after hearing Mr.Dube. Mr.Dube sought one last opportunity to convince this Court that there is a settlement reached and if criminal proceedings are allowed to continue, that would be an abuse of the process of Court.
2.
We have found from the pendency of this application that such settlements although said to be made, are never corroborated and supported by cogent and satisfactory materials. Oral statements made by the advocates are often without proper instructions. In the circumstances, we dismiss this application for want of prosecution, but by keeping all the contentions on merits open. Ad-interim order, if any, granted earlier to stand vacated.
