The affidavit in reply tendered by Mr. Jetly is taken on record.

After hearing both sides, we find that the petition can be conveniently disposed of on the statement made by Mr.Sridharan, on instructions, that the Managing Director of the petitioner no. 1 shall appear before the Senior Intelligence Officer, Directorate of Revenue Intelligence's branch office at Ahmedabad. Needless to clarify, therefore, that the petitioner will be proceeded against J.V.Salunke,PA

33-WP.3281.2017.doc strictly in accordance with law. Now that the learned counsel Mr.Jetly makes a statement, on instructions, that the goods have been provisionally released, we need not keep this petition pending. We clarify that we have not expressed any opinion as far as the merits of the controversy. Needless to clarify that since the petitioners' Managing Director has volunteered to appear before the concerned official, we do not think that the respondents will proceed to act in breach or contrary to any provisions of law.
