1) This is an application under Section 439 of the Code of Criminal Procedure for bail in CR No.I-295 of 2016 dated 16.10.2016 registered with Manikpur Police Station, District Palghar.
2) It is the prosecution case that the applicant who is sub dealer of Idea Mobile Company accepted an application form from accused No.1 Royal @ Roy Sequera for supplying one simcard. That, bogus documents of residential and identify proof were submitted along with the said form. That, during the course of verification of those documents it was revealed that accused No.1 Royal @ Roy has annexed the said documents of residential proof of Aadhar Card of Shri. Niraj Mishra the first informant.
2 /3BA-696-17-944 During the course of investigation the applicant came to be arrested on 18.2.2017.The record reveals that the applicant is a sub dealer of Idea company and used to accept the forms annexed with the residential proof from the customers. The co-accused Royal @ Roy Sequera is also arrested and is in Jail.
3) The record further reveals that the applicant was released on temporary temporary bail by an order dated 10.4.2017 for attending the marriage of his daughter and from 13.4.2017 to 18.4.2017 and the applicant has surrendered himself to the Jail authorities after the said stipulated period It appears that that the applicant has committed mistake/irregularity in accepting the form of co-accused Royal @ Roy Sequera. There are no antecedents at the discredit of the applicant. The investigation of the present crime is practically completed and hence, applicant can be released on bail. 5) Hence, the following order.
a) The applicant be released on bail in CR No.I295 of 2016 dated 16.10.2016 registered with Manikpur Police Station, District Palghar on his furnishing PR bond of Rs.25,000/-with one or two solvent local sureties in the like amount.
b) The applicant shall attend the Manikpur Police Station as and when called for between 11a.m to 1.00 p.m. and to join the process of investigation till the submission of the charge sheet.
3 /3BA-696-17-944 It is needless to mention that before calling the applicant in police station the Investigation Officer shall issue notice u/s.160 of the Cr.P.C. thereby stating the date and aforesaid time.
