On the last date of hearing, a statement was made on behalf of the respondent wife that the amount of maintenance is due and payable.

The learned Senior Counsel Mr. Anturkar representing the petitioner do not dispute the said statement, and in order to clear the arrears, he has handed over demand draft of Rs. 15,50,000/- dated 4/07/2022 towards the arrears of maintenance. 3.
The counsel for the respondent wife who has acknowledged the demand draft, state that he will ascertain the
2/3 3 WP 5248.22.doc actual arrears and if something is over and above the said amount, he shall communicate it to the petitioner and assurance come from Mr.Anturkar that he shall redress the said grievance. 4.
The learned senior counsel further made a statement on the instruction from, the petitioner who is present in the court that as far as the amount of maintenance is directed to be paid i.e. Rs.40,000/- per month i.e. for wife and child shall be deposited in the account of the respondent wife before 5th day of every month. The account details shall be furnished by the respondent to the petitioner.

The parties express their consensus on expeditious disposal of PA No. 1131 of 2017 instituted by husband before Family Court Pune, where he seek dissolution of the marriage on the ground of desertion.
Mr. Anturkar would submit that as far as the factum of desertion is concerned, it is admitted and is obvious. Since petition is pending from the year 2017, but the only animus/ intention will have to be ascertained, in the said proceeding 6.
The parties are at consensus that if a time bound direction is issued to the Family Court to dispose of the proceeding , they shall render all their cooperation for its expeditious disposal. 7.
In the wake of the aforesaid, the Family Court at Pune is requested to conclude the proceedings in PA No. 1131 of 2017 as expeditiously as possible and in any case on or before
3/3 3 WP 5248.22.doc 31 January, 2023. Needless to state that both the parties shall render their cooperation to the Family Court and shall avoid unnecessary/ frivolous adjournments.
With the aforesaid direction writ petition is disposed off. ( SMT. BHARATI DANGRE, J.)
