Heard learned counsel for the parties.

By this civil application, the Applicant- Original Defendant No.2 is seeking injunction restraining Respondent No.1 from issuing joint allotment in favour of the applicant and Respondent Nos.2 to 5 in respect of premises in newly constructed building at Adeshwar Apartment, gala No.20, 504 Khed Galli, Sayani Road, Mumbai - 400 025 during the pendency and final disposal of the First Appeal. 3.

The present civil application was filed on 4th October, 2002. Since then, there is no ad-interim relief.

In view of this fact, civil application stands dismissed as infructuous.

No order as to costs.
