Heard learned counsel for the parties.

By this application, the applicant seeks his enlargement on bail in connection with C.R. No. 225 of 2016 registered with the Goregaon Police Station, Mumbai, for the alleged offences punishable under Sections 370(A)(i) of the Indian Penal Code; under Sections 3, 4 of the Prevention of Immoral Trafficking Act and under Section 4, 8 and 17 of the Protection of Children from Sexual Offences Act.

Perused the papers. The complainant received secret information that a lady named-Rekha Humane i.e. the applicant was providing girls for prostitution to male customers. On receiving this information, a trap was laid, with the help of decoy customer and two panchas at the place, where the applicant was conducting prostitution. The applicant was arrested on the spot and a minor girl aged 17 years and 5 months was rescued.

A perusal of the statement of the victim girl shows the complicity of the applicant. She has stated that the applicant told her that she would earn money from prostitution. She has stated that one month prior to the incident, unknown persons would come for having physical relations with her and that the applicant would lock the door from outside and after an hour and a half, would open the door. The statement of the rescued girl before the Child Welfare Committee is also similar to her 164 statement.

Considering the material on record, this is not a fit case to enlarge the applicant on bail. Accordingly, the application is rejected. 2/3

However, the trial of the applicant is expedited. Learned Judge to decide the matter preferably within 12 months from the date of receipt of this order.
