FINAL ORDER:- Upon hearing the learned counsel appearing for the respective parties, we are inclined to dispose of the present Writ Petition in view of the statement made by the learned counsel appearing for Respondent Nos. 2 and 3, based upon the earlier Judgments and orders in similarly placed matters that- "Respondent Nos. 2 and 3 will pay to the Petitioner monthly salary, in the pay scale prescribed for Assistant Teacher from 20/02/2012 ( i.e. after completing 3 years as Shikshan Sevak) and also will pay the arrears of salary of Assistant Teacher from 20/02/2012 within a period of 4 months, in view 1/2
ssm 2 906-wp3910.17.sxw of the Judgment and Order dated 2 September 2015 in Writ Petition No. 7435 of 2015 passed by the Bombay High Court (Bench at Aurangabad: R.M. Borde and P.R. Bora, JJ.) They would approve the services of the Petitioner provisionally subject to production of Caste Validity Certificate, as per paragraph 4 of the said Judgment".
Considering the fact that the Petitioner's caste claim is still pending with the Divisional Caste Verification and Scrutiny Committee, Thane-Respondent No.4, we direct to decide the said claim as expeditiously as possible, preferably within a period of six months from today, in accordance with law.
Writ Petition is accordingly disposed of with liberty. No costs.
