1] The applicant is apprehending arrest in connection with C.R. No.322 of 2018 dated 16/10/2018 registered with V.B. Nagar Police Station, Mumbai, for the offence punishable under Section 420, 406, 120(B) read with 34 of the Indian Penal Code. 2] Heard the learned counsel for the applicant and the learned APP for the State. Perused the record of investigation. 3] The role attributed to the applicant in the present crime is that, he introduced principal accused Sandesh Malankar with co-accused Ms.Vedkaur Chavariya. Apart from the said fact, the applicant has no 1/3

4] In the present crime, the police have arrested accused Manoj Karkera, Ms.Vedkaur Chavariya and Mohd. Ashraf Khan. Investigation qua the said accused person has already been completed and the police have submitted chargesheet.

5] In view of the role attributed to the applicant in the present crime, this Court is of the opinion that the custodial interrogation of the applicant for further investigation of the present crime is not necessary and the applicant can be protected by pre-arrest bail. Hence, following order.

(i) In the event of arrest in C.R. No.322 of 2018 registered with V.B. Nagar Police Station, Mumbai, the applicant shall be released on bail on his furnishing PR bond in the sum of Rs.15,000/- with one or two local sureties in the like amount.

(ii) Applicant shall not tamper with the evidence and/or interfere with the process of investigation.

osk 7-aba-595-2019.odt (iii) Applicant shall attend the Investigating Officer as and when called for between 10.00 a.m. to 1.00 p.m., after receipt of a notice in writing from the Investigating Officer and to join the process of investigation till submission of final report.
