Heard learned Counsel for the Petitioner and the learned Counsel for the Respondents. After arguing the Petition for some time and on expressing my opinion that I am prima facie satisfied that an Arbitrator is required to be appointed, learned Counsel for the Respondents has fairly agreed to the appointment of an Arbitrator.

Learned Counsel for the Petitioner and learned Counsel for the Respondents have suggested the name of Mr. S.Y. Padhye, Additional District Judge (Retd.) to be the sole Arbitrator. In the circumstances, by consent, the following order being passed :

Order I.

Mr. S.Y. Padhye, Additional District Judge (Retd.), 29, Sylvan Retreat Range Hills, Ashok Nagar, Pune-20, is appointed as sole Waghmare

28.ARP.40.14.doc Arbitrator under the Arbitration & Conciliation Act, 1996 to adjudicate the disputes and differences between the parties. II. Registry shall communicate a copy of this order to the sole Arbitrator together with a memorandum of address of parties. The Petition is disposed of in aforesaid terms. No costs. (A.A. SAYED, J.)
