This is an application for pre-arrest bail in connection with C.R. No. 26 of 2021 registered with Dehu Road police station for the offences punishable under sections 420 and 406 read with 34 of Indian Penal Code, 1860.

While granting interim pre-arrest bail, by an order dated 18th March, 2021, this Court had recorded that the applicant was willing to deposit the entire amount of Rs. 7,07,000/- without prejudice to the rights and contentions.

The learned counsel for the applicant submits that the applicant has deposited the said amount before the trial Court. In the intervening period, post completion of investigation, chargesheet has also been lodged. Vishal Parekar ...1

The learned APP on instruction confirms that the applicant has deposited the said amount of Rs. 7,07,000/-. 5.

Since the charge sheet has been lodged and the applicant had also deposited the entire amount which the first informant was allegedly defrauded with, I am inclined to make the order of interim pre-arrest bail absolute.

Hence, the following order.

ORDER

1] The application stands allowed.

2] The order of interim pre-arrest bail dated 18th March, 2021 is made absolute on the terms and conditions incorporated therein. 3] In addition, the applicant shall regularly attend the proceedings before the jurisdictional Court.
