Advocate for the Applicant states that there was delay in depositing the Award amount. He states that the amount is already deposited, though belatedly.

Since the Award amount is deposited by the Insurance Company, stay granted by this Court on 12 April 2023 is confirmed till the disposal of the First Appeal.

The Interim Application is accordingly disposed of. 4.

At the request of learned counsel Respondent No.1 liberty is granted to prefer an application for withdrawal of the Award amount. If such application is preferred, the same be decided on its own merit. 1/2

Issue notice to the Respondents, returnable on 26 October 2023. Humdast is permitted. Apart from the Court notice, Advocate for Appellant is permitted to serve the Respondents by Advocate's private notice, by all permissible modes and file an Affidavit of service to that effect within six weeks from today.
