This Application is moved for setting aside the order dated 7th March, 2015 in Criminal Miscellaneous Application No. 283 of 2014 passed by the District Judge-2 and Additional Sessions Judge, Sangli thereby cancelling the pre-arrest bail granted earlier by the learned Additional Sessions Judge, Sangli by order dated 28th February, 2011.

During the course of hearing of this matter, the learned counsel for the applicant/accused has submitted that the applicant/accused is resident of Delhi and he is ready to attend the police station as ordered by the police. He further submitted that the applicant/accused has cooperated the police earlier, however, he could not attend the police station at Sangli, which is far away from 1 / 2

15.APL263_2015.doc Delhi. He submitted that the applicant/accused is ready to attend the police station as directed by this Court.

After considering the submissions and as the crime is registered at C.R. No. 1 of 2011 and pre-arrest bail is granted on 28th February, 2011, by the order of this Court dated 2nd February, 2017 the applicant was directed to attend Kupwad M.I.D.C. Police Station on 15th and 16th February, 2017 between 11 a.m. to 2 p.m. Learned APP after taking telephonic instructions from the police, has submitted that the applicant/accused has attended the police station on two dates as per the direction given by this Court. Under such circumstances, order dated 7th March, 2015 passed by the Additional Sessions Judge, Sangli in Criminal Miscellaneous Application No. 283 of 2014 is hereby set aside and cancelled. The earlier order dated 28th February, 2011 of granting pre-arrest bail to the applicant/accused is hereby revived.

Criminal Application is disposed of.
