1) By a reasoned order dated 17.3.2017 the applicants were granted interim relief. The applicant No.1 is the mother in law and the applicant No.2 is the paternal uncle in law of the first informant. The record of investigation reveals that the applicants have already attended the Investigation Officer and have cooperated in the process of investigation. After taking into consideration the allegations made in the first information report and the ratio laid down by the Supreme Court in the case of Arnesh Kumar vs. State of Bihar (2014) 8 SCC 273 the applicant deserves to be granted pre arrest bail. 2) In view thereof, the applicants have made out a case for their release on pre-arrest bail.
3) The interim order dated 17.3.2017 is hereby confirmed. However, the applicants are directed to attend
2 /2ABA-476-17-25 the Investigation Officer as and when called for between 11.00 a.m. to 1.00 p.m. and to join the process of investigation till the submission of the final report/charge sheet.
It is needless to mention that before calling the applicant to the police station, the Investigation Officer shall issue a notice under Section 160 of the Cr.P.C. thereby specifying the date and aforestated time.
