The challenge in this petition is to the order dated 8th August 2007, by which the petitioner's application seeking interim relief was rejected by the Family Court at Bombay.

The impugned order was made in Interim Application No. 95 of 2007 in Petition No. A-115/2007. At this point of time, it is reasonably expected that Petition No. A-115/2007 is finally disposed of. In any case, the reliefs applied for in the present petition will have been rendered infructuous. This is perhaps the reasons why neither the parties nor their advocate are present today.

In any case, the Family Court at Bandra, is directed to dispose of Petition No. A-115/2007, if the same is not already disposed of, as Habeeb 1/2
206.WP.3856.08.odt expeditiously as possible and in any case within a period of six months from today. Until the disposal of the petition, both the parties are directed to maintain status quo in respect of the suit property. 5.
At this point of time, no useful purpose will be served in determining whether interim relief was rightly declined to the petitioner or whether the petitioner should be protected by an interim order. 6.
With the aforesaid directions, this petition is disposed of. There shall be no order as to costs.

The Registry is directed to send an authenticated copy of this order to the 3rd Family Court at Bandra, taking up Petition No. A-115/2007. 8.
All concerned to act on the basis of the authenticated copy of this order.
