This is an application by the appellant/convicted accused, whose appeal is pending before this Court, for permission to travel abroad for his business promotion to foreign countries like UAE, China, Thailand and Saudi Arabia for the period of three months from 15th March 2019 to 15th June 2019 both days inclusive.

Heard the learned Counsel appearing for the parties and perused the record.
The applicant was permitted by this Court vide Order dated 19th December 2018 on Criminal Application No.2026 of 2018 to travel to UAE, China, Thailand and Saudi Arabia for the period of three months from 28/12/2018 to 28/03/2019. As per condition of this Order, he had deposited the amount of Rs.1,00,000/- in the Sessions Court.
It appears that the applicant has returned back prior to due date as stated by him in paragraph 6 of the instant application and had deposited the passport back to the Registrar, City Civil and Sessions Court, Mumbai on 05/03/2019. Now, he wants to travel again to UAE, China, Thailand, Saudi Arabia for the period of three months from 15th March 2019 to 15th June 2019. Security amount of Rs.1,00,000/- in pursuant to earlier Order dated 19th December 2018 is stated to be with the Sessions Court, Mumbai. The applicant, in past, was granted permission to travel abroad and he has not misused such permission.
In the light of these facts, the applicant is permitted to travel to countries like UAE, China, Thailand and Saudi Arabia from 15th March 2019 to 15th June 2019 subject to condition that the amount of Rs.1,00,000/- deposited by him in the Sessions Court will be treated as security for the purpose of this Order. applicant to furnish undertaking stating that he will return to India on or before 16th June 2019 and thereafter, shall surrender his passport immediately. He should also furnish true itinerary to the officer-in-charge of the MRA Marg Police Station, Mumbai before leaving India and he will disclose his address and place of residence in foreign country. He should furnish his contact telephone numbers in the travel schedule. On making compliance of these terms on filing of copy of undertaking as aforesaid with the trial Court, the passport of the applicant be returned to him. Delay of single day in returning to India shall itself result in forfeiture of security deposit of Rs.1,00,000/-. If there are prohibitory Orders from any other Court, in pending cases, if any, the applicant shall obtain necessary permission from those Courts before leaving India. The Criminal Application stands disposed of in above terms.
