Heard. By this Civil Application, the Applicant is seeking stay to the operation and implementation of the impugned judgment and award dated 31.10.2012 passed by the 3rd Jt. Civil Judge, Senior Division, Nasik in LAR No.499/2002 holding that the Respondent - Claimants are entitled to additional compensation of Rs.1,95,477/-.

Office note shows that this court by order dated 08.01.2016 had directed the Applicant to deposit the entire amount of compensation within 12 weeks from the date of order. However, the Applicant has not deposited the said amount.

Considering the submissions made by the learned AGP and the remark made by the office, following order is passed:

a.

If amount is not deposited, the Applicant to deposit the same in the Reference Court on or before 23.08.2019 failing which the Civil Application shall stand dismissed without further reference to the court.

b.

If the amount is deposited within stipulated time as stated hereinabove, the operation and implementation of the impugned judgment and award dated 31.08.2012 passed by the 3rd Jt. Civil Judge, Senior Division, Nasik in LAR No.499/2002 shall stand stayed till hearing and final disposal of the appeal.

c.

Civil application stands disposed off accordingly.

d.

No order as to costs.

At this stage, the learned AGP submits that they have already filed the paper book on 07.10.2015.

Hence, office to verify and place the same on record.

g.

Place the First Appeal on board on 23.08.2019.
