By the present application, the applicant seeks relaxation of the condition imposed on him, while he was released on bail on 27/07/2018 in Bail Application No.1639 of 2018 with the condition that he shall attend the Versova Police Station on

2/3 54 IA-1691.22.odt every first Monday of the every month between 11.00 a.m. and 1.00 p.m.

The order passed on 27/07/2018, released the applicant on bail in connection with C.R. No.103 of 2018 registered with Versova Police Station, Mumbai under Section 370 read with Section 34 of the IPC.

By the present application, the applicant seeks exemption of the condition of attendance, subject to which his liberty was secured. The said request is made in the wake of the fact that the investigation is over and the charge-sheet has been filed and presently the case is pending before the Sessions Court Dindoshi vide Session Case No.187 of 2018.

Learned A.P.P. does not dispute the fact that the charge-sheet is filed and the trial is committed to Dindoshi Court. He fairly submits that the Investigating Officer is not keen and insistent upon the attendance of the present applicant.

In the wake of the above, the condition imposed upon the applicant vide order dated 27/07/2018, directing the applicant to attend the Versova Police Station on every first Monday of the month between 11.00 a.m. and 1.00 p.m. stands relaxed. The

3/3 54 IA-1691.22.odt applicant shall, however, continue to attend the trial, unless on medical ground, or otherwise exempted.

The application stands allowed.
