Heard Mr.Vikram Sutaria the learned counsel for the applicant. Heard Mrs.S.V.Gajare the learned Additional Public Prosecutor for the respondent/State.

The applicant was previously permitted to depart from India. The Sentence imposed upon the applicant is of imprisonment for a period of one year. The sentence has already been suspended. In the ordinary course, the appeal is not likely to be taken up for hearing within a short time. In the circumstances, after hearing the learned counsel for the applicant, I am inclined to allow the application subject to certain conditions. 1/3

The application is allowed.

The applicant is permitted to depart from India and be in the United States of America during the period from 09/06/2015 to 30/07/2015, on the following conditions : (a) The applicant shall deposit cash of Rs.25,000/- as and by way of additional security for her appearance before the appellate Court i.e. this Court and execute an appropriate bond;
(b) The applicant shall not visit any country except United States of America;
(c) The applicant shall give the details of her proposed journey such as Flight Number, Ticket Number, Visa Particulars, etc. to the Investigating Agency, in writing, at least 48 hours before her actual departure from India;
(d) The applicant shall give her telephone numbers and address abroad where she would be available for communication;
(e) The applicant shall return to India on or before 31st July 2015 and report to the Investigating Agency within a week thereafter;
(f) The applicant shall also report compliance with these directions to this Court;

(g) The applicant shall surrender her passport to the Investigating Agency within a week from her return to India.
