Heard learned counsel for the parties.

By this application, the Applicant seeks a direction to the Competent Authority i.e. Passport Authorities, to issue passport to the Applicant, on such terms and conditions, as deem fit by this Court.

The Applicant was charge-sheeted for the offences punishable under the Prevention of Corruption Act. After trial, the learned Special Judge, Pune, Under Prevention of Corruption Act, acquitted the Applicant of all the charges. Being aggrieved by the Judgment and Order of acquittal dated 10th December, 2015, the State preferred an Appeal against the Applicant's acquittal from the said case. The State - Appeal was admitted by this Court vide order dated 16th March, 2018. The Applicant, aged 27 years, has completed his B.E. (Telecommunication) and is working for a private company. The Applicant intends to apply for a passport for further job prospects. It appears that the Applicant has no other case registered against him and in the case in which he was prosecuted, he is acquitted. The Appeal against the Applicant's acquittal is pending in this Court. 4.
Considering the aforesaid, the application is allowed and the Respondent No.2 - Regional Passport Office, Pune, to consider issuance of passport to the Applicant for a period of 10 years, as per the Passport Act and Rules thereunder.

Needless to state, that in case the Applicant intends to travel abroad, on the basis of the passport, so issued, he shall obtain the permission of this Court before travelling.

The Application is allowed and disposed of in above terms. 7.
