1] Mr. Arjunwadkar, the learned counsel for the petitioner in response to the preliminary objection raised by Mr. Adagule, the learned counsel for the respondent agrees that this petition may not be maintainable in view of the decision of the Hon'ble Supreme Court in Shyam Sunder Sarma vs. Pannalal Jaiswal & Ors.1 2] Accordingly, he seeks leave to withdraw this petition with liberty to file appropriate proceedings to challenge the impugned order.

3] Accordingly, leave is granted to withdraw this petition and the same is disposed of. At the same time, liberty is also granted to the petitioner to institute appropriate proceedings for challenging the impugned order.
