This is an application seeking leave to appeal challenging the judgment and order passed by the Metropolitan Magistrate, 14th Court, Girgaum, Mumbai, in C.C. No.549/SS/2005, thereby acquitting the respondent of the offence under Section 138 of the Negotiable Instruments Act. The respondent fairly submits that he has a good case on merits. In view of this, the application seeking leave to appeal deserves to be allowed and the appeal can be heard finally.
