The learned Counsel for the Respondents No.2 & 3 Ms.Baxi on instructions states that a formal show cause notice would be issued to the Petitioner calling upon him to show cause as to why he should not be reverted back to the post of the Assistant Engineer. The learned Counsel further states that the concerned Chief General Manager, Technical who would hear the Petition and pass appropriate orders within 4 weeks from date.

In view the said statement, the order dated 06/01/2018 would accordingly stand quashed and set aside and the Petitioner's reversion would be contingent upon the decision which would be taken by the Respondent No.2. Since the Petitioner has joined the reverted post, the status-quo would be maintained, which would be without prejudice to the rights and contentions of the Petitioner.

With the observations as aforesaid, the Writ Petition is disposed of.
