The Petitioner has challenged the order passed by the Educational Authorities refusing to grant approval to the appointment of the Petitioner.

The proposal was submitted by the Respondent-Management earlier which was rejected. Thereafter, this Court had remanded the matter to the Education Officer. Again, the same has been rejected. According to the Respondent -Management, the earlier order of this Court is on misrepresentation by the Petitioner. It is contended that

Trupti 2 34-wp-6673-2022.doc the present petition is even on misrepresentation and the Petitioner has committed perjury.

According to us, the aspect of perjury need not be gone into this petition. Since the Respondent -Management who has submitted the proposal is not standing by its own proposal and has not challenged the order of rejection, and also specifically contends that the order of rejection is appropriate, then at the behest of the Petitioner, we are not inclined to examine the correctness of the order rejecting the proposal. If the Petitioner has any grievance or claim against the Respondent -Management, we keep the same open to be considered on its own merits.

Writ petition is accordingly disposed of.
