We have heard learned counsel for petitioner and learned APP. The petitioner has not disclosed the fact of appeal preferred by him against order dated 5th December 2018 refusing furlough. Learned APP submits that appellate authority is in the process of deciding the appeal.

In the situation, though learned counsel for petitioner is ready and willing to argue the petition on merits, we find that interest of justice would be met by directing the appellate authority namely Additional Director General, Prisons, Pune, to decide that appeal at the earliest and in any case within a period of three weeks from the date of communication of this order to it. Ordered accordingly. 3.
