Parties got married on 13.03.2019. Respondent - husband initiated proceedings for divorce which is pending on the file of Civil Judge Senior Division at Kalyan of which transfer is sought by Applicant to Civil Judge Senior Division, Bhiwandi where she has filed proceedings against the Respondent and his family under the Domestic Violence Act and Section 498A of the IPC. Applicant is a housewife.

Perused the Application. Grounds stated in paragraph No.3 of the Application have been considered. Since the same are not controverted, in my opinion, ground of hardship has to be considered in favour of the Applicant.

In view of the above, Application is allowed and disposed of in terms of prayer clause (b) which reads as under:- "(b) To transfer the Marriage Petition No. MP/894/2021 pendeing before the Hon'ble Court of Ld. Civil Judge,Senior Division at Kalyan to the Hon'ble Court of Ld. Civil Judge, Senior Division at Bhiwandi."
