This application is made for modification of the order dated 09.06.2014 passed by this Court granting pre-arrest bail to the respondent-accused, who is facing charges of forgery, cheating and misappropriation in C.R. No. 10 of 2013 at Chaturshringi Police Station, District- Pune.

Learned APP submits that the respondent-accused is not co-operating with the Investigating Officer. He further submits that the original copy of Agreement of Sale Deed and the original receipts are

Trupti 904-APPP-232-16.doc not produced by the respondent-accused and, therefore, it is not possible for the Investigating Officer to investigate smoothly. 3.

Learned counsel for respondent-accused submits that the original Agreement of Sale Deed and the original receipts are not in the custody of the accused and the photocopies of those documents are submitted by him to the Investigating Officer. He further submits that the respondent-accused has filed an affidavit to that effect. 4.

Considering these submissions, no order of modification is required to be passed, as it is the duty and skill of the Investigating Officer how to investigate the matter.
