This matter pertains to the assignment of the Hon'ble Shri Justice S.K. Shinde. As the regular Court is not available, the matter is moved for urgent listing before this Court. 1/3

My attention is invited to page 62 of the Civil Application which is E-Tender-cum-Auction Notice inviting tenders for demolition of 53 sheds at Solapur and disposal of scrap materials.

Learned Counsel for the applicant - original respondent No.1 in Writ Petition states that he will have to file an appropriate application before the trial Court seeking appropriate reliefs in so far as auction notice is concerned. He states that bonafide he was prosecuting the application in this Court. The appropriate remedy would obviously be to file appropriate application before the trial Court. To enable the applicant to make an appropriate application before the trial Court seeking appropriate reliefs, for a period of 2 weeks from today no work order pursuant to E-Tender Notice which is at page 62 should be issued.

At the request of learned counsel for applicant, the Civil Application is allowed to be withdrawn. 2/3

All contentions are kept open.

The application so filed shall be considered on its own merits without being influenced by any observations made by me in this order.
