The Applicant herein seeking temporary bail in Criminal Appeal No. 566 of 2017. The Applicant is convicted for the offence punishable under Section 395 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for a period of ten years and to pay a fine of Rs.10,000/-, in default to suffer simple imprisonment for one year.

The Applicant was working with the police department. It is submitted that the applicant herein is in custody since the date of incident i.e. 14/11/2013. Be that as it may, the applicant is seeking temporary bail in order to enable him to appear for First Year Bachelor of Arts examination, which is commencing from 13th March 2019.

The Applicant has placed on record the Hall Ticket issued by Savitribai Phule Pune University. The learned APP has verified the genuineness of the said Hall Ticket and submits that the applicant is to appear for the examination.

In view of this, in the interest of justice, the applicant deserves to be granted temporary bail from 13th March 2019 to 23rd March 2019.

It is made clear that the applicant shall not pray for any extension. In the eventuality, the Applicant does not appear before the jail authorities on 23rd March 2019, he shall be arrested and brought to prison. Hence, the following order: Order i) The Criminal Application is allowed.

ii) The applicant be enlarged on bail on furnishing P.R. bond in the sum of Rs. 15,000/-(Rupees Fifteen Thousand only) and one or more sureties in the like amount.

iii) The applicant be released on provisional cash bail of Rs. 15,000/-(Rupees Fifteen Thousand only) and one or more sureties in the like amount.

iv) The applicant shall surrender himself before Nashik Central Prison by 5.00 p.m. on 23rd March 2019. v) The applicant shall report to Chikhali Police Station every alternative day between 8.30 a.m. to 9.30 a.m.

during the period from 13th March 2019 to 23rd March 2019;

vi) The application is allowed in above terms and is disposed of.
