It is an application for pre-arrest bail by the mother-inlaw and brother-in-law of the deceased in Crime No.92 of 2018 registered with Chakan Police Station for the offence punishable under Sections 498-A, 306, 504 and 506 read with Section 34 of the IPC.

Heard the learned counsel for the Applicants and the learned APP for the State.

It is submitted across the bar that the husband has been released on bail by the Trial Court.

That vide order dated 16.3.2018, this Court granted interim protection to the applicants on certain terms and conditions. Perused the complaint. Though the deceased had committed suicide within two years from the date of marriage, prima-facie, the complaint and the material collected in the course of investigation does not show that the applicants had instigated and/or aided the deceased to commit the suicide. That even otherwise, the applicant no.2 who is student and the applicant no.1 is mother-in-law , were not residing with the deceased. In view of the facts aforesaid, the application is allowed and hence, the following order:

(1) In the event of arrest of the Applicants in Crime No.92 of 2018 registered with Chakan Police Station, they shall be released on bail, on each of them executing the PR Bond in the sum of Rs.20,000/- with one or more sureties in the like amount. (2) The Applicants shall make themselves available for interrogation by Investigating Officer as and when required. (3) Applicants shall not directly or indirectly make any inducement to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police station.
