The Applicant apprehending her arrest, in Crime No. 469/2021 registered with Nigadi Police Station, District Pune under Section 406, 420, 496 read with Section 34 of IPC, is seeking anticipatory bail.

The aforesaid crime is registered on the basis of the complaint dated 19.09.2021 lodged by the victim. The informant/victim is a lady, who had obtained divorce from her husband and is having a child. She was proposing to remarry and therefore, had posted her profile on a matrimonial site, where she got acquainted with the accused No.1 Premraj Thevraj Decruz, Sumedh Sonawane page 1 of 3

who is the husband of the present Applicant. The allegation is that, accused No.1 Premraj Thevraj induced the informant to part with an amount of Rs.20,000/- and also promised to marry with the informant. However, the informant noticed that there were messages of several girls on the mobile phone of Premraj when she became suspicious and refused to marry with the co-accused Premraj. It is, at this stage when the co-accused Premraj Decruz is alleged to have asked the present Applicant (who is his wife) to speak with the informant, introducing herself (the Applicant) as his elder sister, thereby persuading the Applicant to agree for the marriage. This was to extract money from the informant on the pretext of assurance to marry with the informant. 3.

Learned counsel for the Applicant submitted that, there is an inter se dispute between the Applicant and the coaccused Premraj Thevraj Decruz, who is her husband. It is submitted that the co-accused has posted certain explicit photographs of the Applicant on a social site. It is submitted that it was the accused No.1, who had forced her to speak with the informant, introducing herself as his elder sister. 4.

Learned APP points out that there are three other similar complaints registered against the Applicant and her husband and there is a conspiracy and modus operendi in which the husband of the Applicant is trying to cheat various ladies on the promise of marriage in which the Applicant also appears to be Sumedh Sonawane page 2 of 3

a party. The learned APP has produced the details of the offence registered.

Considering the nature of allegations, I do not find that this is a fit case for grant of pre-arrest bail. 6.

The Criminal Application stands rejected.
