DATED : 12th APRIL, 2022 P.C:- This is the second Bail Application, the first one being rejected by me on 19/7/2020, on appreciating the material available against the present applicant in the charge-sheet, particularly in the light of the statement of the son of the deceased Smitil, who is an eye witness.

Mr.Joshi has invited my attention to a subsequent order passed by this Court in case of co-accused Vilas Pandurang Gogavale on 29/11/2021 and the argument is this, in the light of the similar material compiled in the charge-sheet, the learned Judge has deemed it expedient to release the co-accused on bail. 2/2 10 BA 1063-22.doc In the wake of the aforesaid subsequent development, he seeks withdrawal of the application with liberty to approach the Sessions Court, claiming parity with the co-accused, taking advantage of the fact that the co-accused being released on bail. Application is disposed off with liberty as prayed. Needless to state that the withdrawal is sought for, I have not heard the application on merits.
