Heard the learned Counsel for parties.

By this Contempt Petition, the Petitioner - wife is urging that in spite of the interim order passed by this Court on 17/01/2013 in Civil Application No.90 of 2012, the Respondent - husband performed second marriage with one Manisha, daughter of Avdhesh Chaurasiya. In support of this, she is relying on the photo-copy of the invitation card Exh.C to the petition.

Learned Counsel for the Respondent filed Affidavit-inreply and denied this fact. The Respondent called upon the Petitioner URS

2 CP 331-14.doc-17 to produce the original copy of the invitation card Exh.C to the petition. For that purpose, the matter was adjourned from time to time. The Petitioner filed Affidavit of four persons who attended the marriage, but has failed to produce on record the original copy of the invitation card. In para 7 of the Contempt Petition, the Petitioner mainly relied on the invitation card.

Considering the fact that the Petitioner did not have original copy of the invitation card, there is no question of entertaining the present Contempt Petition. Hence, the Contempt Petition stands rejected.
