2 By this First Appeal, the Appellant/Original Defendant No.1 is challenging the Judgment and decree dated 24/12/2014 passed by the Learned Civil Judge, Senior Division, Dadra and Nagar Haveli, Silvassa in Special Civil Suit No.

22/2013 restraining the Appellant from carrying out any construction or to change the nature of the suit property without due process of Law or without obtaining lawful permission from the competent Authority.

3. Considering the submission made by the Learned Counsel for the Appellant and the impugned Judgment and award, I am satisfied that the Appellant has made out a case for the following order:
