By order dated 13th April, 2017, statement made on behalf of the petitioner that the petitioner will deposit entire dues

2 11-W.P. No.4433-2017 of respondent No.4-Bank on or before 27th April, 2017 was recorded. The matter was adjourned to 28th April, 2017. Mr. Khandeparkar upon taking instructions from Mr. Rama Sahebrao Waghmare, Director of the petitioner states that the petitioner has not deposited the amount as per order dated 13th April, 2017. He, therefore, seeks permission to withdraw the petition with liberty to adopt appropriate proceedings.

Mr. Ghosalkar states that auction has taken place on 17th April, 2017.

In view thereof, on the motion made by Mr. Khandeparkar, petition is allowed to be withdrawn with liberty to adopt appropriate proceedings. Petition is disposed of accordingly. [R.G. KETKAR, J.]
