This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicants are apprehending their arrest in Crime No. 172 of 2023 registered at Indapur Police Station, for the offences punishable under Sections 306, 427, 504, 506 r/w. 34 of Indian Penal Code.

I have heard the learned Counsel for the applicants and the learned APP for the State.

According to the prosecution, on 9 January 2023, the present applicants and other co-accused assaulted the deceased as he was found roaming around with the girls from the family of the applicants and other co-accused. It is alleged that present applicants and other co-accused had threaten to kill him. It is alleged that due to fear, on 10 January 2021, the deceased had hanged himself and committed suicide. 5.

There is a delay of about 28 days in lodging the report/ Even otherwise, considering the overall facts and circumstances of the case, I am inclined to grant anticipatory bail to the present applicants. In the result, the following order is passed :

(i) Application is allowed.

(ii) In the event of arrest of the applicants in Crime No. 172 of 2023 registered at Indapur Police Station, for the offences punishable under Sections 306, 427, 504, 506 r/w. 34 of Indian Penal Code, they shall be released on furnishing P.R. Bond in the sum of Rs.25,000/- each with one or more sureties in the like amount. (iii) The applicants shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation.
