P.C. :
Heard the learned counsel for the parties.
This is an application for grant of interim bail in Crime No.I/06/2016 registered at Mahatma Phule Chowk Police Station, Kalyan (East). The accused is protected by interim bail granted by this court on 21st March 2016.
avk 1/3
According to the learned counsel for the applicant, he is falsely implicated in the present crime and has no role to play. According to the learned APP the applicant is habitual in committing similar types of crime by preparing bogus documents which are made available to the persons who on the basis of such documents obtain loans from the banks. The learned APP has further submitted that apart from the present crime, three more crimes of similar nature are registered against the applicant and has thus opposed the bail.
Perused the documents available on record. It appears that the involvement of the applicant in this crime is based on the statement of co-accused Iqbal Abdul Jabbar. Except for this, there is nothing to establish the involvement of the applicant. The learned APP on instructions from the Investigating Officer has stated that in the other three crimes the applicant is released on bail and the charge-sheets are already filed. avk 2/3
In that view of the matter and having considering the involvement of the applicant, based on the statement of coaccused, I am inclined to confirm the interim bail granted to the applicant on the same conditions.
The application is allowed.
Interim relief is confirmed.
