This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 643 of 2022 registered at Shirur Police Station, for the offences punishable under Sections 326, 307, 323, 341 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, there was a dispute between the present applicant and the complainant on account of certain business Kanchan P Dhuri 1 / 2

27-ABA-813-2023.odt related issues. It is alleged that thus on the date of incident, which took place on 21 September 2022, the co-accused in the present crime had assaulted the complainant by wooden stick at the instance of the applicant and caused him grievous injury.

Pursuant to the order passed by this Court dated 17 March 2023, the applicant without prejudice to his rights and contentions has paid an amount of Rs.1 lakh to complainant/victim towards medical expenses. There are no other criminal antecedents. Considering the over all facts and circumstances, I am inclined to grant anticipatory bail to the present applicant. In the result, the following order is passed : (i) Application is allowed.

(ii) In the event of arrest of the applicant - Pravin Bhaga Ohol in Crime No. 643 of 2022 registered at Shirur Police Station, for the offences punishable under Sections 326, 307, 323, 341 r/w. 34 of Indian Penal Code, he shall be released on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount. (iii) The applicant shall attend the concerned police station as and and when called by the Investigating Officer and shall cooperate in the investigation.
