Heard learned Counsel for the applicant. The applicant is agitating the validity and legality of the order dated 10th November, 2017 passed by the City Civil Court, Mumbai in Misc. Application No. 89 of 2015 filed by the applicant-legal guardian for grant of permission for sale of immovable property and purchase of another property to incur day to day expenses of the mentally retarded son by name Jessica.

Taking into consideration the subject matter, there is no impediment to condone the delay for filing the First Appeal against the impugned order passed by the learned trial Court. There is no any respondent in the matter for hearing on the issue of condonation of delay. However, in the interest of justice, for detail hearing to award substantial justice it would just and proper to condone the delay. Hence, civil application stands allowed in terms of prayer clause (a). The delay in filing First Appeal against the impugned judgment and order passed by the learned trial Court, stands condoned.
