The challenge in the Suit was to the rateable value fixed by the Municipal Corporation of Greater Mumbai. The MCGM was directed to assess the rateable value of the property at the rate decreed and excess payment was allowed to be adjusted. If the Appeal succeeds, undoubtedly the Respondents will be liable to pay the balance amount with arrears. The MCGM has enough powers to recover the amounts due.

The Civil Application is dismissed. There will be no order as to costs.
