The Petitioner has taken various contentions in this petition. The learned counsel for the Petitioner states that due to endlessly prolonged enquiries, the Petitioner is suffering harassment at the hands of Respondent Corporation, more particularly chances of promotion are jeopardized. The learned counsel for the Respondents states that departmental enquiry has been initiated against the Petitioner sometime in December 2019.

If any departmental enquiry is proposed against an employee, such departmental enquiry, subject to co-operation of the said employee, has to be taken to its logical end as early as possible to avoid prejudice to all concerned. Service Rules governing this contingency generally prescribe a time limit for disposal of the enquiries.

In these circumstances, keeping all the contentions of the parties open to be urged in the departmental enquiry/ enquiries and keeping in mind the orders passed by this Court earlier on this aspect, we direct the the Respondent- Municipal Corporation to complete the enquiry/ enquiries as early as possible within the prescribed time specified in the service conditions applicable to the Petitioner, subject to co-operation of the Petitioner during enquiry proceedings.
